Ramenki District Police Department: what happens at the police station and why you need an advocate there

Where the department came from

The territorial police departments of the Western Okrug grew out of the militia stations of the municipal okrugs of the early 1990s. Order of the Mayor of Moscow No. 30-RM of 25 January 1994, which created the Nikulinsky Intermunicipal Court, described its territory through the internal affairs departments of the okrugs of Ramenki, Matveevskoye, Prospekt Vernadskogo, Troparyovo, Ochakovo and Nikulino and the 6th militia station at Moscow State University. After the districts were enlarged in 1997 (Ramenki was merged with the Mosfilmovsky district) the departments took district names, and after the 2011 reform and Federal Law No. 3-FZ of 7 February 2011 "On the Police" they received their present name: Department of the Ministry of Internal Affairs of Russia for the Ramenki District of Moscow. It reports to the Western Okrug Police Directorate.

The university campus is served not by the district department but by a separate police station serving Moscow State University on Leninskiye Gory, the heir of that 6th militia station.

What happens at the department

• Registration of reports. Any crime report must be accepted around the clock, registered in the incident log and acknowledged with a receipt (Article 141 of the Criminal Procedure Code of the Russian Federation; Order No. 736 of the Ministry of Internal Affairs of 29 August 2014).
• Preliminary check: interviews, requests for documents, inspections. The period is 3 days, extendable to 10 and 30. It ends either with a case being opened or with a refusal. A refusal is appealed to the Nikulinsky Inter-district Prosecutor's Office and the Nikulinsky District Court.
• Inquiry and investigation of offences within police jurisdiction: theft, fraud, robbery, drugs, road accidents with injuries, minor and medium-gravity economic offences. Grave crimes against the person and official misconduct are passed to the Nikulinsky Inter-district Investigative Department of the Investigative Committee.
• Administrative proceedings: protocols under the Code of Administrative Offences, administrative detention up to 48 hours, transfer of materials to justices of the peace of precincts Nos. 177–180 or to the district court.
• Detention of a suspect under Article 91 of the Criminal Procedure Code: a protocol within 3 hours, the right to a phone call, the right to a defence lawyer from the moment of actual detention. Persons detained for 48 hours are sent to the temporary detention facility of the okrug directorate rather than kept at the department.
• Migration unit: registration of foreign nationals, work patents, protocols under Chapter 18 of the Code of Administrative Offences. For a district with embassy compounds and a university this is a visible part of the department's work.

What the bar association does

Advocates of the Moscow Bar Association "Kovalev, Malyutov, Tsypkalo & Partners" come to the department on Michurinsky for detentions and interviews, take part in interviews at the check stage, draft crime reports so that they are not refused, and challenge refusals and inaction.
