The Prosecutor's Office in the Western Okrug: Nikulinsky Inter-district Prosecutor's Office and the Western Okrug Prosecutor's Office

Three hundred years of supervision

The Russian prosecutor's office dates from the decree of Peter the Great of 12 (23) January 1722 establishing the office of Prosecutor General at the Senate, "the sovereign's eye". The Soviet prosecutor's office was re-established in 1922, and the present status is set by Federal Law No. 2202-1 of 17 January 1992 "On the Prosecutor's Office of the Russian Federation". In 2022 the service marked its tercentenary.

Inter-district prosecutor's offices appeared in Moscow together with the intermunicipal courts in the 1990s: one office for several districts, with boundaries matching the district court's territory. That is why the Nikulinsky office serves the same territory as the Nikulinsky District Court and the Nikulinsky Inter-district Investigative Department, and shares a building with the latter in the Olympic Village. The okrug is overseen by the Western Okrug Prosecutor's Office on Kutuzovsky Prospekt, and above it stands the Moscow City Prosecutor's Office on Krestyanskaya Zastava.

What the prosecutor does in a criminal case

• Supervises checks of crime reports and quashes unlawful refusals to open a case. A complaint to the prosecutor about a police "refusal" file often works faster than going to court.
• Considers complaints against investigators and inquiry officers under Article 124 of the Criminal Procedure Code of the Russian Federation within 3 days, in complex cases up to 10.
• Consents to an inquiry officer's motion for arrest and takes part in the hearing on the pre-trial measure in the Nikulinsky District Court.
• Approves the indictment or returns the case to the investigator. This is the last moment before trial when a case can be stopped or reclassified.
• Presents the state prosecution in the Nikulinsky District Court and before justices of the peace, and appeals judgments to the Moscow City Court.

What the prosecutor does outside criminal cases

A prosecutor's inspection under Article 21 of the Federal Law "On the Prosecutor's Office" can come to any company in the district: on a worker's complaint, on a resident's appeal, on instructions from a higher office. The inspection is conducted by the prosecutor's decision stating its subject and term; the prosecutor may not request documents outside the subject. The result: a representation, a warning, a decision to open an administrative offence case, or referral of materials to the police or the Investigative Committee. The prosecutor's office also files claims in the interests of an indefinite circle of persons: such claims on landscaping and safety appear constantly in court news.

How to apply

• Written appeals are accepted at the registry, by post and through the online reception on the epp.genproc.gov.ru portal, and also through Gosuslugi. The review period is 30 days, shorter for complaints about the investigation.
• Personal reception is held by the prosecutor and deputies according to a schedule; appointments through the reception.
• A complaint about the inter-district office is filed with the okrug office, and about the okrug office with the city office.
