Personal bankruptcy of Ms Kh.: bank debts discharged
Ms Kh. could no longer service her bank loans. Attorney Dmitry Malyutov ran a financial analysis and filed a bankruptcy petition; the Commercial (Arbitrazh) Court of the Ulyanovsk Region — a state commercial court — declared her bankrupt. Debt of 1.9 million roubles was discharged.

The task
Ms Kh. asked the bar association to settle her relations with the banks: she could no longer repay her loans. The case was complicated by the fact that she actually lived in Moscow while being registered in the Ulyanovsk Region.
What we did
Attorney Malyutov analysed her financial position and decided to petition the court to declare her insolvent (bankrupt). A complete set of documents was prepared for filing with the commercial court at her place of registration.
The outcome
On 26 June 2020, in case No. А72-3325/2020, the Commercial Court of the Ulyanovsk Region declared Ms Kh. bankrupt and opened a six-month asset-realisation procedure. The attorney supported her throughout the procedure — until the 1.9 million roubles owed to the banks was fully discharged.
The result in one case neither guarantees nor implies a similar result in another. Bankruptcy is declared by the commercial court.
